8/26 Distribution finished
After 6 months the medical records distribution is over. 4950 records were given, mailed, and delivered to patients and physicians offices. 519 boxes of charts came in, 319 will go out for destruction. A huge task. Every effort was made to locate active/recent patients. For those whose records were missing, about 60 patients, I personally went through every box a 2nd time over the last week and a half looking for them without success - at least they won't be amongst those being destroyed.
I do not know where the Phoenix Project will go next - I know I'll be taking a long break to let my back heal! Watch this space......
8/12 FINAL WEEK!!!
This coming Sunday will be the final distribution day, the last day patients may pick up their records. Please call me at 787-8005 to request them by this evening. We've distributed 4586 so far. I am personally going through every box this last week, looking for the 60 or so lost files and making one final effort to contact those who we were unable to reach before. We have attempted to contact every patient seen since 2005, and I believe we were successful 95% of the time - many patients have moved and disconnected, but oftentimes an emergency contact listed in the record will provide a new number. Once again my heartfelt thanks to the volunteers for their time and enthusiasm, and to the patients who generously contributed to help cover our expenses. We're fortunate to live in such a caring community.
8/1 4315 records back to patients!
2 weeks to go - all patients with current phone numbers seen since 2005 have been called about picking up their records. From the initial 519 boxes of records received from the trustee and county we're down to 341, from the initial inventory of 39,700 records we're down to 23,400. This massive volunteer effort is winding down - only 2 more Sundays left - huge thanks to everyone who has helped with the task - we made a difference to a lot of people.
7/25 OVER 4000!!!
4035 records distributed, with only 3 weeks to go. We hope to reach our goal of 5000 by the end of the distribution period. If you've requested records, or been called and wish to pick them up, please call me - all remaining records will go down to San Jose for shredding right after our last day, which will be Sunday Aug 15th.
7/13 We're on the Eve of Destruction
Only 5 weeks left until all records are destroyed. 3600 have been distributed, but there are still just over 24.000 records remaining. Don't delay - call me on 787-8005 to get your records.
6/27 OVER 3000!!
3081 records distributed - the pace intensifies as we get closer to the destruction date. A real testament to the hard work of the volunteers, spending many hours calling, delivering, and mailing records out. Please note - We will be closed next Sunday, July 4th - our next distribution day will be July 11
6/15 2506 records distributed!!
We now have 4 volunteers calling patients from home, and the pace has increased dramatically. We will reach our goal of contacting every patient possible with at least a month to spare before the destruction date. Huge thanks to the volunteers who give so much of their time to make this happen.
6/8 2290 records distributed!
We're not slowing down! Thanks to very dedicated volunteers the remaining boxes are being gone through and patients are being called at a record rate. If you can spare a few hours to call patients from your home please contact me.
5/28 Over 2000!
2005 records out! We're now at the halfway point, with 2 1/2 months to go before all remaining records are destroyed. Please take a moment to contact us, either phone, email or fax, while you think about it. Remember, you can pick up all your family's records, there are no lines, and we're friendly and helpful too! Would like to make a big push now to get all remaining boxes gone through and patients contacted - if you can spare 3 hours a week to help please contact us. 5/5 1625 records back to patients!
It seems that despite the length of time since the clinic closed, patients are still eager to retrieve their records, and rightly so - you never know when something in your past history will become important. Having sorted through the remaining records that have been carried back and forth since the start, I now have space for many more boxes each weekend of those patients who still haven't been contacted. We would certainly appreciate anyone willing to spend 3 hours a week calling patients to help get as many back as possible before the August destruction date. Please note - We will be closed May 30th, Memorial Day weekend
4/20 1278 records distributed!
Over 2 months into the distribution we've now managed to get 1278 records back to patients. After carrying 400-500 of the same records back and forth each weekend that don't get picked up, we will now have to start returning many of them to storage and eventual destruction, in order to make space in the car to bring fresh records of people not yet contacted. PLEASE NOTE - we will be closed next Sunday, April 25th, because of the Dream Machines traffic. Our next distribution date will be Sunday May 2, 10am-4pm, at 575 Kelly Ave at the new Purisima Family Medicine office.
3/22 Nearing the first 1000!
967 records distributed since we started, still many more patients yet to be contacted - our volunteers will be setting up outside New Leaf and Safeway to spread the word and get request forms filled out. We're working through, box by box, but the records not yet picked up limits the number of boxes able to be brought down to the distribution site and gone through. So patients, if you've requested your records, or been contacted about them, PLEASE come down and pick them up! Please note - We will be closed April 4 (Easter Sunday) and April 25 (Dream Machines).
2/28 3rd weekend
A very successful weekend - 239 records out the door, bringing the total since we started to just over 600 distributed! Huge thanks to the many volunteers who are calling patients and pulling records, couldn't do it without you all. We're now going to Sundays only - 10-4, closed 12:45-1:15. We've simplified the process - all family members can now be put on one form. If you've requested your records, please pick them up - otherwise they have to be carried back and forth each weekend, leaving less room for other records.
2/22 2nd weekend
Apparently the word is spreading - over 200 records were distributed, with no lines and very little wait. The volunteers were amazing, locating records, helping with the paperwork, and calling as many patients as possible to let them know their records were available. Please help by letting friends and family know about this. The easiest way is to email me with names and birthdates - I'll respond within 24 hours to let you know if we have your records.
2/15 First weekend
An excellent start, 76 records got back into patient's hands. No lines and only a few hiccups. A few points to note, to expand on the notice and release forms above:
1. Please do not disturb Purisima Family Medicine during the week - no calls or stopping by the office - they are running a medical practice and it can be quite disruptive. No records are held there, they cannot answer questions about your records or the distribution - if you have questions please ask us. They are being incredibly generous in allowing us to use their office on weekends, please don't jeopardize the arrangement.
2. It takes time to retrieve your records. I can only pick up records from SourceCorp once a week, on Fridays at noon, and those records that are now here comprise over 500 boxes stacked 7 or 8 high, making access time-consuming.
3. It would be best if patients can email me their names and birthdates - that way I can check if their records are on the inventory, and possibly save them a trip and disappointment, or let them know when we'll be able to bring them to the distribution.
4. If faxing or mailing in a release form, please put an email address or phone # so we can contact you.
5. Patients who requested their records from the trustee back in Aug/Sept, but were unable to pick them up, are especially encouraged to contact me. Those records were kept separate by the trustee, rather than being re-filed, and therefore much easier to access.
2/5 - FINALLY!
After months of discussions, at the final court hearing this morning the judge approved the order giving guardianship of the remaining records to the Phoenix Project! Handover will be tomorrow. This is no small task, and no small responsibility, but thanks to our many volunteers who've waited patiently to help, we can get started. Please rest assured no records will be destroyed until August, and all volunteers are under strict confidentiality agreements. The notice and release forms are above, but I will paste the notice out in full here so that everyone understands the process. I hope it's clear, please email with any questions.

If your records are among those currently in storage, your medical records will be available for pickup at the office of Purisima Family Medicine, 575 Kelly Ave, HMB, (corner of Church St) on Sundays only – please do not disturb the office staff during the week. From now until mid-August, we will be open Sundays 10-4, closed for lunch 12:45-1:15pm. Please follow the procedure below to obtain your records.
Either simply email names & birthdates and fill out the release form when picking up, or to save time complete a release form first, which will be available at the office during the above times, or online at www.hmbphoenix.org/latestinfo.php, for yourself and your family, with your names and dates of birth. Spouses/partners & adult children who are unable to visit the office during pickup hours may designate their spouse/partner or parent to pick up their records.
Patients who have transferred their care to a local Coastside physician may have their new physician’s office request their records from us directly, and these will be delivered during the week to their offices – please check with your doctor’s office, some may wish you to pick them up and bring with you on your next visit. Unfortunately we are unable to hand-deliver records to out of area physicians.
Patients who have moved out of the area may request mail delivery – we will need the release form and a copy of photo ID – we will pack your records and have them weighed for delivery via USPS media mail with signature confirmation, and then request payment of the cost of shipping – once received they will be mailed to you.
Once your information has been received your records will be retrieved from storage and available for pickup. Please bring a photo ID.
This will be a free service, however in order to help cover our expenses we would appreciate a small voluntary tax-deductible contribution of $5 per patient if you are able.
Please help spread the word to any former patients you know, especially those who may have moved out of the area. We only have until mid-August, after which remaining records will be destroyed.

12/17 4th mediation conference
We have a location for the records distribution - many thanks to Drs. McMillan, Pavliscak and Oppenlander of Purisima Family Medicine, and the building owner George Desalernos, who have offered us the use of their waiting area at 575 Kelly Ave. Again this will be weekends only, Sat & Sun 10am-4pm, for the 1st 4 weeks, then Sundays only after that - please do not disturb the practice staff during the week. Unfortunately, due to another delay with the court process, the order likely won't be issued until the end of January, so our start date will be February at the earliest - most frustrating. Thanks to Bev & Kris for setting out a very festive holiday party last night, and all the volunteers who attended.
12/7 3rd mediation conference
We're almost there! Good progress has been made, with almost all the details worked out. We have secured storage space for the trustee's 10,000 records, have an agreement with SourceCorp in San Jose for weekly pickup of requested records, and are very close to finalizing the office space for distribution. This has all been possible through collaborative efforts by the trustee, the former Board of Directors of the clinic, the bankruptcy court judge, and the Phoenix Project. A written motion still has to go before the original court judge, and due to the time needed, and the holidays, that won't happen on Dec. 11 as scheduled - there will be a final mediation conference Dec. 17 and an appearance before the original judge in early January. More delay I'm afraid, now 9 months since the clinic closed, but the bankruptcy system moves on its own timeline. Only a little while longer now. Wishing everyone a happy and healthy holiday season.
11/16 2nd mediation conference
A followup conference was held 11/16 to discuss progress made. So far all are in agreement that having Phoenix handle ongoing distribution is in the best interests of the community. Phoenix would take guardianship of all 10,000 records the trustee currently holds, to be moved back to the Coastside for easier access. The trustee would therefore no longer be responsible for mailing records. The issue of obtaining records from SourceCorp is still unresolved, and communications are underway with the executive team there. Supervisor Gordon's office staff are close to finding office space for the distribution, with all the details having been worked through. It appears that we will be responsible for ongoing utility costs, storage, office supplies, and transportation costs, and therefore may have to ask a small token fee, likely $5 per record, either fixed or voluntary, to cover these costs. I have heard concerns from patients regarding their need to pick up spouse's or adult children's records - they may be working or at college out of the area - and we will make every effort to overcome this difficulty. Perhaps even something as simple as placing them in sealed envelopes stamped across the flap may suffice. Office hours are expected to be Sat & Sun, 10am-4pm. Another followup conference will be held Dec 7, with finalization of the court order likely on Dec 11.
10/20 Mediation conference
The mediation conference between the trustee and her attorney, and the former Board of Directors and their attorney, with an assistant US attorney and me present, was held this morning with Judge Carlson mediating. After 3 hours of discussion, the bottom line is that the previous 2 day record distribution held in September was a step in the right direction, and needs to be continued on an ongoing basis. The former Board, with Steve Wilson and Ev Ascher present, suggested they could try to find space, perhaps an office in the old clinic that has separate access, and equip it with phone & fax. The trustee, with only 2 office staff, could not take on the role. Community volunteers would be needed to man the office, and I put myself forward to fill the role. This is still in the preliminary stage, with all the details needing to be worked out, and will be discussed again at another conference Nov 16. The approx 10,000 records held by the trustee, and the approx 24,000 held at SourceCorp in San Jose, would be made available for distribution to patients to pick up at no charge. The option of mailing records to patients would still be available thru the trustee, at $25 per record (not $35 as mentioned below). We would also ask that records be allowed to be distributed to patient’s new physicians at no charge, if the patient wished. The patients would still need to sign the appropriate records release form, and be required to present photo ID to pick up their records, similar to the Sept distribution. Parents would be able to pick up their minor children’s records. However, spouses or partners would not be able to pick up their spouse’s record, due to confidentiality issues, nor their adult children's for the same reason. In the case of a deceased family member, the executor could pick up the record upon presentation of the appropriate paperwork. Office hours would be arranged to accommodate the needs of working people, most likely evenings or weekends. Again, this is all preliminary, and final details remain to be worked out. This would allow for the ongoing distribution of remaining records at reasonable hours, without the long lines, or the worry of someone being away or otherwise unavailable on a certain date. No records will be destroyed until at the earliest Aug 17, 2010, so plenty of time for those still in need of their records to get them in time.
9/15 Requesting records by FedEx
Many patients saw the long lines last week and chose not to wait, or were unavailable. You now have the option to request your records from the trustee by completing the release form below and mailing it in with a check for $25 per record. This fee expires Sept 30, after which they will be making an additional 24,000 records available from SourceCorp, which are mostly 'inactive' or earlier volumes of records from longstanding patients, and the fee will likely rise to $35. No records will be destroyed until August 17, 2010, so you have time, but the earlier the better.
9/3 New group practice announces opening date!!
Breaking news straight from the doctors - their practice, Purisima Family Medicine, will open its doors Sept 14th. Appointments can be made now - please see the CFMC Physicians page on this site, or go to their website here. We at Phoenix wish them all the best as they start their new practice, and know that their loyal patients will be most pleased to see them again.
9/2 HMB Review details a few issues with records distribution
Mark Noack has been diligently following the issue, and his article this week can be read here. I was one of those who hadn't received a letter, despite being on the inventory, and I faxed in the release form anyway. I emailed the trustee regarding it today, and received a prompt courteous reply. As the article notes, be prepared to wait - I suggest lightweight chairs, water and a good book! Don't forget to bring photo IDs. They're doing their best in a difficult situation to comply with the law - let's be respectful and understanding, and appreciate their efforts - remember, they took over this mess in May, with no control over what went on before then.
8/26 Options if unavailable on pickup dates
2 days till the deadline to return release forms in order to pick up your records at no charge. If you or a family member are unavailable on the 8th or 9th, or if you don't get the release forms back by the 28th, the trustee's office has said they will mail or FedEx your records for $25 per record - FedEx to home or USPS certified/registered to PO Box in order to have a signature on record. Many people have not received the letters, including a large portion of the Hispanic community. We've translated it into Spanish (see below)and made it available thru distribution at Our Lady of the Pillar this past weekend, as well as copies at Moonridge and Puente de la Sur. If you haven't received the letter, simply download the release form from our site (for English version click on link under 8/18), print it out and fax in to the trustee.

8/18 Trustee letters & release forms
Letters have begun arriving in patients mailboxes today from the trustee, detailing the records release procedure and containing a release form. Although there is a limited time frame to return the forms (by August 28) to the trustee, the letter indicates that records will still be available after that date on payment of a processing fee. No unclaimed records will be destroyed until August 17, 2010, 1 year from the date of the letter, as per federal healthcare clinic bankruptcy law. 8/17 Update
No letters received so far, so there may be a slight delay in the process. Several patients have contacted me with concerns as to whether they should initiate contact or wait. I would suggest waiting till at least the beginning of next week before contacting the trustee's office. Most concerning is those patients who've moved away since the closure, and mail may not be forwarded in time. My suggestion there, if possible, is have a friend who's also a former patient fax a copy of the release form (that will be in the letter) to you. One article has suggested the trustee may mail records out if the patient covers the cost - see Mark Noack's article here. Another concern is that the letters will not include a Spanish translation, despite the large number of Hispanic patients. View Julia Scott's article here.
8/7 Judge approves motion to dispense records!!
At the bankruptcy court hearing this morning, the judge approved a motion by the trustee to distribute patient's records. He indicated that he felt this was a high-priority issue, given the public interest, patient's concerns, and local media attention, and was disappointed that the mediation conference had not been scheduled. The trustee declared she is prepared to move forward with immediate distribution of the 13,000 records she currently has in a self-storage facility. She has worked to get names and addresses from the files, and has a quote from Kinko's to do a mass mailing of all 13,000 patients within the next 2 weeks. Patients will have 10 days from receipt of the letter to contact her office to request their records, and she will then pull the files ready for distribution. These will be the original records, with no copies being made, a matter of no small concern to the former physicians, as this practice was stopped in the early days following the closure by the attorneys. No indication of how or where the records will be available was given. The mediation conference discussed at the previous hearing was delayed due to holiday scheduling difficulties between all parties, but the judge is pleased that things are moving, and has scheduled a followup status hearing Sept 22 at 9:30 in his courtroom. There was no opposition by the CFMC attorneys to this motion. Once the number of records left over is known, the matter of the dismissal of the bankruptcy will be heard again. This is great news for patients, as there is finally, after nearly 5 months, some movement on distribution of records. We have not as yet been asked for our assistance, and it may not be necessary as the trustee appears to have her own plans in motion. Further details will be made available as they become known. Fingers crossed one and all!!!
7/24 Court hearing leaves matters unresolved
The court hearing to decide whether to dismiss the bankruptcy ended without definite resolution (see Mark Noack's article here. Many interesting points came to light, including the fact that the 13000 records from the clinic picked up by SourceCorp were not in fact taken down to San Jose, but are currently in a self-storage locker in Belmont! These include the remainder of the active records (approx 3000) not distributed before the bankruptcy filing, as well as approx 10000 inactive ones that SourceCorp did not want to take to San Jose, as they hadn't been paid for storing the 24000 they currently hold. The judge was most concerned about the rancor between the trustee and the former Board, as shown in the court filings, and wanted that to cease, in the interest of the 'innocents' most affected, i.e. the patients who still don't have their records. To that end he has asked all the parties to come to the table, with another judge as impartial mediator, to attempt to resolve the issue. He has let the trustee know that he would look favorably on allowing her to use volunteers to assist with distribution. This is most encouraging, and shows that there may be light at the end of the tunnel, despite the trustee's somewhat disparaging comments in the article regarding volunteers. In fact her comments don't reflect our proposal to her, in which we would have committed to a one year plan to handle the remaining records at the clinic. I will be contacting the volunteers to see if they're still interested in helping, and then communicate that to the mediator.
6/27 – Trustee files to dismiss bankruptcy
Thanks to Mark Noack’s persistence in keeping this issue current, he has found that the trustee has filed to dismiss the bankruptcy on the grounds that there are no assets left to cover the cost of storing and distributing patient’s records, and that the former Board of Directors & CEO should be liable for such costs – see his full story here , or read the front page article in the July 1 HMB Review. SourceCorp, a records storage company in San Jose, which has stored approximately 24,000 inactive records from the clinic, has confirmed that they’ve picked up approximately 13,000 records from the closed clinic and have them in storage. SourceCorp’s phone number is 408-436-1701. I spoke with Liz Allen, who is handling the records for CFMC, and she informed me that they cannot distribute any records until the 'custodian', i.e. the trustee right now, gives them direction on how to do it. The case will be heard on July 17th in the bankruptcy court in San Francisco, which means more delay before you can access your records - over 4 months since the closure! One thing you can do now is get hold of copies of any lab or radiology results from where you had them done, copies of admission and discharge summaries from any hospitalizations, or copies of charts from specialists visits, and try and recreate your own chart. 6/13 - Medical Records update
Last week's HMB Review article stated the situation fairly clearly. Basically the trustee has decided that we are not going to be handling the records, as we are a new volunteer group, and she had concerns about how long we would be able to carry out the task, as well as concerns about volunteers handling the records. It appears likely that SourceCorp in San Jose will remove all the records, inventory them along with the approx 22,000 inactive records they already hold, and once a local contact person or agency is found to handle the records requests and money they will begin to distribute them. That seems to be the sticking point right now. The Coastside Healthcare Committee has been asked to take over that role, and are looking into the feasibility of doing it. Given that the records are the last stumbling block before the bankruptcy can be wrapped up, it is likely that the situation will be resolved soon

Since the records are currently held at the clinic, the Phoenix Project has no access to them.

6/2 - Community meeting
Our 4th community meeting only had 7 attendees, so no further meetings are scheduled at this point.

5/15-19 Medical records
We sent in our proposal on May 15 to the trustee, outlining how we would handle the 4000 records still left at the clinic, as well as maintaining any unrequested records for a year as mandated by federal bankruptcy law (Section 351). At the same time, a proposal on behalf of SourceCorp, a San Jose company with a long history of records storage and handling, was submitted. They already have approx 1500 file boxes of inactive records from CFMC.

Their proposal contained a provision the records be kept for 7 years, as mandated by state law.

When HMB Phoenix questioned the proposal, we were told that no records would be released to local primary care providers, or to the former CFMC physicians, or to MPMG or HPSM, unless a flat fee payment per record was made to SourceCorp. Also, that patients requesting their own records, after payment of the fee, would receive the original record, with no copy being made, a matter of some concern medico-legally for the CFMC physicians (that practice was stopped by the CFMC attorneys soon after it started, during the early days after the closure). Nor would a master list of patient's names be released to HMB Phoenix.

It did contain provisions that HMBPhoenix would receive, and validate, each records release form, as well as the appropriate fee, and send them to SourceCorp, who would then distribute the record by mail.

At this point it is a draft proposal, and we do not know which way the trustee will decide. We would likely not be a party to this shared agreement as written, given the above concerns.

5/15 - Proposal for Medical Records distribution given to trustee
The trustee requested proposals for the secure, timely, & cost-effective distribution of the remaining 4000 records at CFMC. Two digital scanning companies, one in San Francisco and one in San Jose, put in proposals, as well as the Phoenix Project. The one in San Jose has the benefit of already holding 1500 file boxes of 'inactive' records from CFMC, so they're familiar with the CFMC charts. However, they are far from the Coastside, and the mechanism for payment for records by patients and physicians, and ease of distribution, is unclear.

We feel that our proposal is cost-effective, at no charge to the trustee, and will be handled in the community, by community volunteers, securely under HIPAA privacy rules and confidentiality agreements. We have heard your concerns over the past weeks, and take them to heart - it's been over 2 months since CFMC closed, and 4000 of you still don't have your records - incredibly frustrating, aggravating, and impairs the continuity of your medical care. That's why we have plans in place for as rapid a distribution as possible, hopefully 1500 within the 1st week and another 1500 within the next 2 weeks - I have lists of patient's records that were not located from MPMG (118) & HPSM (458)- that's 576 right there. It will be our only focus, my only job every day.

But it's in the hands of the trustee now, and the bankruptcy judge.

5/12 - MEETING WITH TRUSTEE
Members of the Phoenix Project, Dr. Page and Dr. McMillan met with the trustee and her team today. Representatives from the County were also present, as they lease the whole building. It was a long discussion, mainly regarding our concerns with the medical records, but also touched on equipment, phone messages left on the machine, accounts receivable and creditors.

The trustee is obviously most concerned with the records issue - a top priority for her - she is well aware that close to 4000 patients have been waiting 2 months for their charts. However, she has to start from last week when she was assigned to handle the Chapter 7 bankruptcy.

Her chief concern about the charts is maintaining the security and integrity of the records. She listened carefully to what we proposed, raised good points and questions, and will consider what we've offered as far as volunteers cataloging, locating, mailing and copying the charts. Unfortunately, she has to present any proposal to the bankruptcy court, a process that can take 1-3 weeks, and nothing can happen till then. So it means more waiting.

While there we noticed the fax machine was out of ink & paper, so please DO NOT USE the old clinic fax number (726-9317). Instead, use ours - 318-3634.

5/8 - NON-PROFIT PAPERS FILED
Thanks to our volunteer local attorney, the Articles of Incorporation for the HMB Phoenix Project were filed today. The process should take about 2 weeks, but once done we can apply for grants, raise funds, accept donations, etc.

VACCINE REGISTRY TRAINING

Thanks to a suggestion from Dr. Page, I contacted Robin Ziegler at the County who trained me on the Bay Area Vaccination Registry. The Registry keeps files on all immunizations given in the County. This will allow me to locate children's immunization records online, without having to look at their chart.

Once downloaded, they can be emailed to the parents, who can print them out. This is critical for parents, who will need the records for summer camp, school, university, etc.

Please email me at ombudsman@hmbphoenix.org with your child's full name and date of birth, and you'll receive them within 1-2 days. I suggest you print out 2 copies, and encase them in plastic for safekeeping.

5/6 - 2ND COMMUNITY MEETING AT COASTSIDE LUTHERAN CHURCH
Town hall meeting style kept everyone interacting, asking questions and raising issues. Attended by around 40 community members, the 2 hour discussion covered the progress made so far, especially the medical records issue, our new contact information, volunteer opportunities, reviewing the 8-point ombudsman plan progress, and covering questions raised at the 1st meeting.
